Meal & Rest Penalty and Sick Records

If there were also meal and rest penalty hours or sick hours that have override rules paid during the bonus period, then additional dollars owed are also calculated.

If there is a nondiscretionary bonus and meal and rest/sick being paid on the same paycheck, the additional amounts are computed by the nondiscretionary bonus. This is because wages (and override rules) are computed first, and the override rule would not have the bonus amounts because they are not computed yet.

If there are two checks for one week, and the bonus was paid on first check, and the sick/meal and rest paid on the second check then the second check (the override rule) must include the nondiscretionary bonus amounts from the first check. Therefore, when there are sick/meal and rest records that require additional dollars owed because of the nondiscretionary bonus, the check includes the hours from wages on other checks (like the normal override rule) but for wages, it only includes the allocated bonus amounts from this check.

Summary:

  • When sick/meal and rest is paid first and the nondiscretionary bonus paid second the nondiscretionary bonus is responsible for paying the additional amount for sick/meal and rest whether or not an override rule exists.
  • When both the nondiscretionary bonus and sick/meal and rest are paid on the same check the nondiscretionary bonus is responsible for paying the additional amount for sick/meal and rest.
  • When the nondiscretionary bonus is paid first and sick/meal and rest with an override rule is paid second, the override rule includes the extra nondiscretionary bonus allocation dollars.
  • When the nondiscretionary bonus is paid first and sick/meal and rest without an override rule is paid second, nothing is done because there is not an override rule to obey.

For meal and rest with no override rule and also for override rules that have a current week allowed, when the minimum threshold is met, the current week is used with the following information:

  • The lookback start and end are the current week
  • The lookback hours are the current week hours
  • The lookback bonus amount is the current week allocated bonus
